How we comply with privacy obligations?
This Privacy Policy sets out the policy of Olympic Gym 2019 Limited with respect to the way in which we collect, use, store and disclose information about you, including through our website at www.olympicgym.co.nz
This Privacy Policy explains our approach to the handling of personal information, and how we comply with our privacy obligations. We are bound by the Privacy Act 2020. This Privacy Policy applies to Olympic Gym its employees and contractors.
By using our website or services, you consent to the collection, use, storage and disclosure of your personal information in accordance with this Privacy Policy. You may withdraw your consent at any time, however we may not be able to continue to provide you with our services or access to our website.
What personal information do we collect from you?
We may collect personal information directly from you:
when you provide business cards or other documentation to us containing such personal information, including when you complete a Membership Agreement and a Health Questionnaire;
in the course of providing our products and services to you;
when you communicate or interact with us, whether in person, by email, telephone or otherwise; and
through your use of olympicgym.co.nz(our website).
The types of personal information generally collected by us may include:
your name, address, date of birth, mobile and telephone numbers and e-mail address;
your credit card or bank account details;
your occupation and your employer;
information about your health that is necessary to properly advise you about fitness training; and
information collected by our CCTV cameras when you access our premises.
When you use our equipment, you may choose to integrate data from other third party applications that you use (such as LF Connect and YouTube), to enhance your experience.
When you use this functionality you consent to us:
receiving your personal information from the relevant third party application; and
using, disclosing, and storing that personal information in accordance with this Privacy Policy to the extent required by us to provide you with this functionality.
You can stop the integration with any of your third party applications at any time by changing the settings within the relevant Apps, in which case we will no longer have access to that information after you change the settings.
How does Olympic Gym use my personal information?
We may use your personal information:
to identify you, so we can give you access to our services and to ensure that your account is secure;
to communicate with you;
to inform you about our new products and services or any changes to existing products and services, or for any other marketing and promotional purposes;
to answer your questions and deal with any issues regarding our products and services;
to carry out our business, which includes maintaining your account, planning, training, product development, research and analysis;
to comply with applicable laws and regulations; or
for any related purpose in connection with the above.
We may use any information that we collect from you that is not personal information
(so no individual can be personally identified from it) for our business purposes, including:
to assess how our customers use our products and services;
to improve our products and services; and
for marketing and promotional purposes.
Does Olympic Gym share my personal information with anyone else?
Olympic Gym will disclose your personal information in a few different ways.
Like most businesses, sometimes we outsource or “contract out” specific support services from time to time, and this may mean that our contractors see your personal information. For instance, sometimes we may engage IT contractors to maintain our databases. All our contractors are subject to strict confidentiality obligations, which means that they are authorised only to use personal information to provide the services or to perform the functions required by us.
We may also disclose your personal information to:
Government departments or law enforcement agencies (including the Police);
liquidators, administrators or other persons appointed to administer your financial affairs; and
debt collection services or credit reporting agencies.
Otherwise, we will only disclose personal information with the consent of the relevant individuals or if it is necessary for the purpose for which you gave us the information.
For example, if you are a member, with your consent (and only with your consent) we may provide personal information to Olympic Gym personal trainers to assist you to improve your fitness and wellbeing, and so they can advise you which fitness programs are suitable for you. If personal trainers are contractors (rather than employees), their contracts with us require them to keep your personal information confidential. Of course, all our employees are required to keep your personal information confidential also.
Cookies
When you visit our website, we may collect certain data that does not identify you (sometimes called “web log information”) when you visit certain pages, such as the type of browser and operating system you have. We may also use “cookies” which are small files that are stored on your computer and that manage the security and navigation process of the site.
You can choose to block these cookies but some portions of the site may not function correctly if you do. This type of data is collected for statistical purposes only, and while cookies will identify your computer, they are unlikely to identify you personally.
What to do if you don’t want our mail-outs?
In each email or each piece of marketing material that you receive from us, you can immediately unsubscribe from our mailing list by using the “unsubscribe” facility contained in each electronic publication we send. In any event, you can opt out from receiving promotional material by e-mailing our Privacy Officer and asking to be removed from the mailing list. Alternatively, you can mail a request asking for deletion. Our contact details are set out below. There is no fee due to us for any such deletion.
Security
We take reasonable steps to keep your personal information secure and confidential and to keep this information accurate and up-to-date. Your personal information is stored behind industry standard firewalls and where applicable, protected by user names and passwords. Where appropriate, your Personal and Sensitive Information is kept within a locked storage room.
Our website uses up-to-date technology to maximise the security of your personal information.
We will not retain any of your information for any longer than it is required by us except to fulfil our legal obligations or where you have consented.
Links to other websites
Our website and communications to you may include links to third party websites which we do not control. Those websites are subject to their own privacy policies. We have no liability for the content and legal compliance of those third party websites, or the personal information they collect from you.
Changes to our Privacy Policy
From time to time we may decide to amend or update this Privacy Policy. When this occurs, we will post any changes on the website. We encourage you to periodically review this Privacy Policy so that you remain informed as to how we are protecting your personal information.
Access and correction of your personal information
You can ask to obtain access to or for us to correct your personal information that we and/or our contractors hold, although under some circumstances permitted by law, we may not provide such information to you.
We may ask you to put your request in writing. It is important to us that the personal information we hold about you is accurate, complete and up to date.
Breaches of your privacy
We take our privacy responsibilities seriously. In the unlikely event that a suspected or actual breach of your personal information occurs, we will investigate the breach. We will notify you and the Privacy Commissioner if we reasonably believe that the breach has caused you serious harm, or is likely to cause you serious harm.
